The petitioners are the husband and members of the matrimonial family of the defacto complainant. Learned counsel for the petitioners submits that the first petitioner lodged a complaint against the defacto complainant and her family members on 19th March, 2025. As a retaliation, the present complaint has been filed. Learned counsel for the State opposes the prayer. I have perused the material on record.

There is no contemporaneous medical evidence in support of the case made out by the prosecution. Investigation has proceeded to a considerable extent.

Considering the material on record and extent of complicity of the petitioners in the alleged offence, this Court is inclined to grant anticipatory bail to the petitioners.

Accordingly in the event of arrest, the petitioners namely Manoj Roy, Mistu Roy, Ritu Roy Saha and Sujay Kumar Saha be released on bail upon furnishing bond of Rs.10,000/-(Rupees Ten Thousand) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The first petitioner shall appear before the investigating officer of the case once a week till submission of charge sheet.

The application for anticipatory bail is thus disposed of.
