It is contended that no overt act was attributed to the petitioner. He prays for bail. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record including statements of eye witness recorded under Section 164 Cr.P.C. which show that petitioner and other co-accuseds being armed with various weapons and bombs attacked the victim and killed him. In view of the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
