Learned counsel appearing on behalf of the petitioner/financial institution submits as follows. The petitioner had filed an application under Section 14 of the SARFAESI Act before the respondent no.1 on 14.08.2023 for getting physical possession of the secured assets. Yet, till date, the same has not been taken up for consideration by the respondent no.1.

Learned counsel appearing on behalf of the State expresses surprise at such delay.

It is indeed very surprising that an application under Section 14 of the SARFAESI Act filed by the petitioner has been kept pending allegedly without taking any steps. In view of the above, let the respondent no.1 act strictly in terms of the provisions of the SARFAESI Act and take immediate steps for completion of the proceeding in accordance with law and as expeditiously as possible.

With these observations, the writ petition is disposed of.
