Learned counsel for the petitioners submits that the petitioners have been falsely implicated and have no nexus with the alleged offence.
Learned counsel for the State opposes the prayer. I have considered the material on record. Petitioners' names appear to have transpired from source information, the source not being disclosed in the case diary. It prima facie appears that the petitioners were not present at the place of occurrence. No injury was inflicted upon the police
personnel by them. Considering the material on record available in the case diary and extent of complicity of the petitioners in the alleged offence, this Court is inclined to grant anticipatory bail to the petitioners.
Accordingly, in the event of arrest, the petitioner (1) Sahidul Haque and (2) Abdul Kuddus @ Kuddus Ali be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.
The application for anticipatory bail is, thus, disposed of.
