Heard learned advocate for the petitioner and learned advocate for the state.

It appears that commercial quantity of narcotic drugs were seized from the possession of the present accused petitioner. Considering the seriousness of the crime and keeping in mind the statutory restriction under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, we are not inclined to exercise our discretion in favour of the present accused petitioner. Considering the long pendency of the case before the learned Trial Court, the learned Trial court is, hereby, directed to consider the charge as against the charge-sheeted accused persons in respect of the caption mentioned case positively

within three months from the date of communication of this order.

The application for bail is, accordingly, rejected. CRM (DB) 498 of 2023 is dismissed.
