1. The writ petition is disposed of with a direction upon the District Inspector of School (Primary Education), Cooch Behar to treat the same as a representation of the petitioner and pass a reasoned order upon considering the case sympathetically. The petitioner has only a shortfall of 1 month 7 days from being eligible to avail of pensionary benefits. The petitioner relies on the circular dated February 3, 2009 in support of the contention that, the shortfall can be condoned. The petitioner also relies upon the decision of the Division Bench passed in MAT 1917 of 2019 by which the order was passed upon the authority to condone the shortfall with reasons.
2. The petitioner will be heard. The school authority will also be heard and a reasoned order will be
passed and communicated. The entire exercise will be completed within 10 weeks from date.
3. There shall be no order as to costs.
4. The authority will act on the basis of the server copy of this order.
