1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Matter is heard in presence of the learned advocates representing the petitioner and State respondents.

3. Petitioner retired on superannuation from the post of Assistant Teacher in a Government aided school on 31st January, 2019. Considering superannuation of the petitioner Pension Payment Order was issued on 22nd January, 2019 thereby retiral dues including pension were released under ROPA 2009 Rules.

4. Learned advocate representing the petitioner submits since petitioner retired on superannuation on 31st January, 2019 petitioner is entitled to receive benefits under ROPA 2019 Rules but benefits under ROPA 2019 Rules till date have not been extended to the petitioner. Petitioner claims revised benefit under ROPA 2019 Rules.

5. This Court finds no purpose would be subserved in keeping this writ petition pending.

6. Leave is granted to the petitioner to make a representation to the District Inspector of Schools (SE) Jalpaiguri being respondent no. 4 by fortnight from date claiming revised benefits under ROPA 2019 Rules. If such representation is made within the aforesaid time District Inspector of Schools (SE) Jalpaiguri shall decide the same in accordance with law by 6 (six) weeks thereafter and decision to be communicated to the petitioner by 10 days thereafter.

7. Writ petition stands disposed of.
