2. Challenge in this revisional application is the order dated 14th June, 2024 in connection with NDPS Case No. 49 of 2023 arising out of Bhaktinagar Police Station No 384/23 dated 15.05.2023 under Section 21(C)/22(b)/25/29 of Narcotic Drugs and Psychotropic Substance Act, 1985.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is the owner of the vehicle seized connection with this case and on prayer learned Special Judge considered the prayer for releasing the vehicle on behalf of the petitioner and passed an order directing to furnishing bond of Rs.3,00,000/- with two sureties of Rs.1,50,000/- each one of them must be local subject to satisfaction of learned Chief Judicial Magistrate Jalpaiguri along with other conditions.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is not in a position to meet amount

of bond and prays for reducing the bond with sureties to PR bond.

5. Learned counsel appearing on behalf of the State opposes the prayer.

6. From the record, it appears that order was passed on 14.06.2024 but till date petitioner could not release the vehicle on furnishing bond.

Given facts and circumstances, the condition of furnishing bond is modified as follows:- Vehicle be released on furnishing bond of Rs.2,00,000/- with two registered sureties of Rs.1,00,000/- each to the satisfaction of learned Chief Judicial Magistrate, Jalpaiguri, with all other conditions already imposed by the learned Judge Special Court.

8. With this aforesaid modification of the impugned order, the revisional application stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
