Mr. Debojit Kundu ...for the petitioner Mr. Subir Kumar Saha Mr. Momenur Rahman ...for the State Petitioner has come up with this writ petition claiming appointment on compassionate ground in view of death of his father in harness who was working in the post of Group-D in Mathabhanga Municipality District-Coochbehar. After the death of petitioner's father on 5th August, 2013 mother of the petitioner made an application on 24th February, seeking appointment on compassionate ground. It has been submitted that till date no steps have been taken by the concerned respondent authorities on the prayer of the petitioner for providing appointment on compassionate ground. State respondents are represented by learned advocate.
Having regard to the aforesaid facts this Court directs the Director of Local Bodies, Government of West Bengal to take decision on the entitlement of the petitioner to get appointment on compassionate ground by passing a reasoned order within a period of 16 weeks from the date of communication of the
order. Before passing a reasoned order the Director of Local Bodies is directed to grant opportunity of hearing to the petitioner and the representative of Mathabhanga Municipality. The decision to be taken by the Director of Local Bodies shall be communicated to the petitioner within 2 weeks thereafter.
With the aforesaid direction the writ petition stands disposed of.
The learned advocate representing the petitioner is granted leave to amend the cause title and add Director of Local Bodies, Government of West Bengal as additional respondent. The advocate of the petitioner is also directed to communicate this order along with copy of the writ petition to the added respondents within a period of 2 weeks from the date.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
