1. Both the writ petitions are taken up together as similar issues are involved.

2. The writ petitions had been filed by persons whose names had been deleted from the record of rights pursuant to an alleged fake deeds. Orders were

passed by this Court time and again by constituting a committee to enquire into the matter.

Although, the record of rights in respect of both the petitioners were corrected, the petitioners submit that the documents, on the basis of which the initial illegality in deleting the names of the petitioners from the record of rights had been made by the concerned Block Land and Land Reforms Officer, are still not available.

4. The documents are necessary in future, in case rival titles are set up by those persons who had procured such fake and forged deeds. Enquiry reports have been filed before the Court which records that more than 5000 files relating mutation cases are missing from the office of the respondent no.4. The petitioners have made allegations against the erstwhile Block Land and Land Reforms Officer, who has since been transferred, and also against the head clerk. The petitioners have reason to believe that the erstwhile Block Land and Land Reforms Officer and the head clerk of the office were instrumental in making the erroneous entries in the record of rights by illegally initiating several mutation cases. They were responsible for the disappearance of the records. The Assistant Director, Block Land and Land Reforms Officer, Rajganj, Jalpaiguri has

lodged a complaint before the Inspector-in-Charge, Bhaktinagar Police Station, Rajgang, Jalpaiguri requesting an investigation with regard to the allegations of the petitioners and on the findings of the enquiry committee.

5. The allegations are serious and the fact that more than 5000 files and records are missing from the office of the Block Land and Land Reforms Officer is also admitted in the enquiry report. Under such circumstances, the matter needs to be further enquired into and investigated upon, in order to appropriately proceed against the wrongdoers.

Under such circumstances, the I.G., North Bengal is requested to constitute a Special Investigating Team comprising of senior police officials including the Inspector-in-Charge of the concerned police station/stations having jurisdiction over the alleged offence allegedly committed by the persons mentioned in the complaint. The team shall also investigate whether the erstwhile Block Land and Land Reforms Officer and the head clerk of the office were in collusion with these offenders. An FIR will be registered on the basis of the complaint already filed and the said investigation shall continue expeditiously. Necessary steps shall be taken in accordance with law and the investigation shall be reached to its logical conclusion.

7. With the above observations, the writ petition is disposed of.

8. The authorities under whose disciplinary control the erstwhile Block Land and Land Reforms Officer and the concerned head clerk were functioning, shall be at liberty to take appropriate steps in terms of the service rules, on the basis of the findings of the enquiry committee with regard to the missing records.

9. Accordingly, the writ petitions along with the connected applications are disposed of.

10. Parties are directed to act on the basis of the server copy of this order.
