Mr. Shibendra Nath Chattopadhyay, learned advocate appears for the petitioner.

Mr. A.S. Chakraborty, learned A.P.P. appearing with Mr. N. Chakraborty, learned advocate represents the state. It is submitted on behalf of the State that no copy of the revisional application has been served on the State. Mr. Chattopadhyay, learned advocate appearing for the petitioner submits that his prayer is very limited to the extent for a direction for an expeditious conduct of the trial. The accused person is more than 80 years of age.

The order impugned in the revisional application is 3rd August, 2021.

Considering the aforesaid and considering the material on record, the learned Judicial Magistrate, 1st Court, Alipurduar is requested to conduct the trial in C.R. case No. 68 of 2014 as expeditiously as possible immediately after resumption of the regular functioning of the Court.

Mr. Chattopadhyay shall serve a copy of the application upon the learned A.P.P. through his e-mail.

With the aforesaid direction CRR 157 of 2021 stands disposed of.

There shall be, however, no order as to costs. (Aniruddha Roy, J.)
