CIRCUIT BENCH AT JALPAIGURI CRIMINAL MISCELLANEOUS JURISDICTION C.R.M. (A) 460 of 2025 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Pradhan Nagar Police Station Case No. 43 of 2025 dated 19.01.2025.

It appears that the main thrust of the allegation is against the principal accused. The petitioner happens to be the friend of the principal accused. Charge sheet has been submitted. Custodial interrogation of the petitioner is not required.

In view of the above as well as considering the extent of complicity of the petitioner in the alleged offence, this Court is inclined to grant anticipatory bail to her.

Accordingly, in the event of arrest, the petitioner Muskan Gupta be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is, thus, disposed of.
