(A) 469 of 2025 In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kotwali Police Station Case No. 198 of 2025 dated 13.04.2025.

Learned counsel for the petitioner submits that the petitioner is the wife of the principal accused who is on bail. Besides an amount of Rs.50,000/- being paid through UPI transaction in her account, there is no other involvement of the petitioner in the alleged offence.

Learned counsel for the State opposes the prayer. I have considered the material on record. It appears that the principal accused has duped job aspirants of huge amount of money on the false assurance of procuring job. The principal accused is on bail. An amount of Rs.50,000/-

was paid to the principal accused through the account of the present petitioner who is his wife. Besides the same, there does not appear to be any other document till date to suggest prima facie involvement of the petitioner in the alleged offence.

Considering the fact that the petitioner is a lady and also in view of the extent of her complicity in the alleged offence, this Court is inclined to grant anticipatory bail to her.

Accordingly, in the event of arrest, the petitioner Smt. Rinki Roy be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. It is expected that the petitioner shall cooperate in investigation of the case. The application for anticipatory bail is, thus, disposed of.
