This is an application for transfer of O.C. Suit No.104 of 1992 along with Misc. Case, being No.3 of 2023 (Sri Santanu Biswas -versus- Smt. Rikta Behara & Sri Durga Prasad Sharma alias Durga Kharel).

The opposite parties are represented.

By consent of the parties, the following order is passed:

(i) The learned District Judge, Darjeeling is directed to transfer the records pertaining to O.C. Suit No.104 of 1992 along with Misc. Case, being No.3 of 2023 from the court of the learned Civil Judge (Senior Division) at Darjeeling to the court of the learned Civil Judge (Senior Division), competent jurisdiction at Siliguri.

(ii) The transfer should be effected as expeditiously as possible.

(iii) Till the records are transmitted, the further proceedings in the suit shall remain stayed before the learned Civil Judge (Senior Division) at Darjeeling.

Nothing further remains to be adjudicated in this revisional application. The same is accordingly disposed of.
