IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction C.R.M. (A) 471 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Tufanganj Police Station Case No. 142 of 2025 dated 18.03.2025 under Sections 221/223/121(2)/109/3(5) of BNS, 2023.

And In Re : Aaminur Haque @ Aminur Haque ...the petitioner.

Mr. H. S. Podder ... for the Petitioner.

Mr. Nilay Chakraborty Mr. A. Sarkar Ms. S. Adhikary ...for the State.

Heard learned counsels for the parties.

The petitioner appears to be a cattle smuggler who is named in the FIR. It is alleged that he alongwith others pelted stones at BSF personnel when they were found to be crossing the border.

Learned counsel for the State opposes the prayer. I have considered the material on record. Considering the nature of offence and prima facie involvement of the petitioner therein, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail is rejected. The application for anticipatory bail is disposed of.

Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
