The petitioners are the members of the matrimonial family of the defacto complainant and friends of her husband. The principal accused has been granted bail. Charge sheet has been submitted. Injuries appear to be simple. There is no material in the case diary to corroborate the statement of the defacto complainant recorded under Section 164 of the Code of Criminal Procedure.
Learned counsel for the defacto complainant submits that the matter has been amicably settled between the parties and the defacto complainant has no allegation against the petitioners.
In view of the above and considering the material on record, this Court is inclined to grant anticipatory bail to the petitioners.
Accordingly, in the event of arrest, the petitioners (1) Smt. Chumki Bhuimali, (2) Sri Santa Bhuimali @ Santo Bhuimali, (3) Pocha @ Pijush Roy and (4) Saniya @ Saniya Saha @ Sunny Kumar be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The application for anticipatory bail is, thus, disposed of.
