Mr. Debojit Kundu ...for the petitioner Mr. Subir Kumar Saha Mr. Momenur Rahman ....for the State Affidavit of service filed on behalf of the petitioner is taken on record.

Petitioner has approached this Court with the present writ petition, inter alia, praying for appointment on compassionate ground in view of death of her father in harness on 2nd April, 2013. The father of the petitioner was working on substantive basis in Group-D post in Haldibari Municipality District-Coochbehar. After the death of the employee the married daughter of the petitioner made an application dated 24th December, 2013 to the concerned respondent authorities requesting to take steps for providing appointment on compassionate ground.

It has been submitted that in spite of making such application till date no steps have been taken by the authority.

State-respondents are represented by learned advocates.

Having considered the submission made on behalf of the petitioner this Court directs the Director of Local Bodies, Government of West Bengal to take decision on the entitlement of the petitioner being married daughter to be appointed on compassionate ground by passing reasoned order within a period of 16 weeks from the date of communication of this order. Before taking such decision the petitioner or her representative shall be given opportunity of hearing. The decision to be taken by the Director of Local Bodies shall be communicated to the petitioner within 2 weeks thereafter.

With the aforesaid direction, the writ petition stands disposed of.

Learned advocate for the petitioner is granted leave to amend the cause title of writ petition and add Director of Local Bodies, Government of West Bengal as additional respondent in course of this day. After amending the cause title learned advocate for the petitioner is further directed to communicate

this order along with a copy of the writ petition to the added respondent within 1 week from date. The learned advocate representing the Staterespondents is also directed to communicate this order to the Director of Local Bodies, Government of West Bengal immediately.

There shall be no order as to costs.

The writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
