For the State The learned advocate for the petitioner submits that the petitioner is innocent of the charges and the marriage was solemnized 28 years prior to the date of death. Learned advocate further submits that the present petitioner being in custody for about a year, he may be released on bail on any stringent condition.

Learned advocate for the State produces the Case Diary and draws the attention of this Court to the statement of the child recorded under Section 164 of the Code of Criminal Procedure. We have perused the materials on record and prima facie, we find that the complicity of the petitioner do not warrant his release on bail at this stage.

Accordingly, the prayer for bail of the petitioner is refused.

The application for bail being CRM 1038 of 2021 is dismissed.
