Report submitted by Mr. Luksom, learned advocate appearing for the State reflects that the warrant of arrest so issued is pending and till date no proclamation has been issued by the learned Chief Judicial Magistrate, Jalpaiguri. In view of the aforesaid, the warrant of arrest so issued be stayed till 21st October, 2022.
The petitioner is directed to surrender/appear before the jurisdictional court within the aforesaid period. It is further directed that in case the petitioner does not appear before the jurisdictional court on 20th October, 2022, learned Magistrate will be at liberty to issue harsher process of law on 24th October, 2022.
With the aforesaid observations, CRR 172 of 2022 is disposed of.
Pending application, if any, is consequently disposed of.
