Learned counsel for the petitioners submits that there is no prima facie material under Section 109 of the BNS against the petitioner. The other offences alleged are bailable.
Learned counsel for the State opposes the prayer. I have considered the material on record. There is no allegation of assault either in the written complaint or in the material available on record. Investigation has commenced in March, 2025.
Considering the material on record and extent of complicity of the petitioners in the alleged offence, this Court is inclined to grant anticipatory bail to the petitioners. Accordingly, in the event of arrest, the petitioners (1) Surojit Banik @ Pompom and (2) Papai Pandit @ Bapai Pandit be released on bail on furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.
The petitioners shall appear before the Investigating Officer of the case once a week till submission of charge sheet.
The application for anticipatory bail is, thus, disposed of.
