IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction C.R.M. (A) 480 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sitalkuchi Police Station Case No. 179 of 2025 dated 22.04.2025 under Sections 126(2)/115(2)/74/117(2)/118(1)/109/351(3)/3(5) of BNS, 2023. And In Re : Pradip Barman & Ors.

...the petitioners.

Mr. Swarup Das ... for the Petitioners .

Mr. Tapan Bhattacharjee Mr. Dhiman Sil ...for the State.

Heard learned counsels for the parties.

Learned counsel for the petitioners submits that there was a free fight between the parties and both the parties sustained injuries. The petitioner sustained severe injuries and a counter case has been lodged.

Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioners inflicted serious injuries on the persons of the victims. The counter case lodged by the petitioners was only on 24th April, 2025, that is, two days after the earlier complaint was lodged.

Considering the nature of offence and prima facie involvement of the petitioners therein, prayer for anticipatory bail is rejected.

The application for anticipatory bail is disposed of. Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
