IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction C.R.M. (A) 483 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sahebganj Police Station Case No. 401 of 2024 dated 10.07.2024 under Sections 126(2)/324(4)/117(2)/109/118(1)/351(2)/3(5) of the BNS, 2023. And In Re : Umzad Ali @ Amjad Ali & Anr....petitioners. Mr. Sudip Guha ... for the Petitioners. Mr. Abhijit Sarkar Mr. Kallol Nag ... for the State.

Heard learned counsels for the parties.

Prayer for anticipatory bail of the petitioners was turned down by this Court on 23rd September, 2024. There is no change in circumstances of the case which warrants fresh consideration of the present application. Though the learned counsel for the petitioners submits that three of the co accused have been granted bail, record reveals that they were granted bail primarily on the ground of their detention. Such fact can not be termed as a change in circumstances of the case.

In view of the above, prayer for anticipatory bail is rejected.

The application for anticipatory bail is disposed of. Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
