It has been submitted by the learned advocate for the petitioner that CRR 122 of 2021 and CRR 121 of 2021 were directed to appear under the heading "For Orders" by an order dated August 23, 2021 passed by a co-ordinate Bench of this Court. It has been further submitted by the learned advocate for the petitioner that since the records are not available on the returnable date before the Principal Bench, the matter could not be taken up on that date.

Learned advocate for petitioner also submits that a compromise has been arrived at between the petitioner and the de facto complainant to resolve the dispute amicably. The learned advocate for the petitioner submits that the petition filed by the petitioner herein for adjournment on the ground of pendency of criminal revision cases were rejected by the impugned order and warrant of arrest was issued fixing April 11, 2022 for execution.

Heard the learned Advocate for the State.

It, prima facie, appears that the criminal revision cases challenging the further continuance of G.R. Case No.1168 of 2017 is pending and since it has been submitted by the learned for the petitioner that a compromise has been arrived at between the petitioner and the de facto complainant, the operation of the order dated October 5, 2021 shall remain stayed till November 15, 2021. It will be open to the petitioner to approach the concerned Additional Chief Judicial Magistrate, Siliguri to bring to the notice of the ACJM, Siliguri that a compromise has been arrived at between the petitioner and the de facto complainant. If such approach is made by the petitioner, the concerned Additional Chief Judicial Magistrate, Siliguri shall decide the same in accordance with law.

CRR 162 of 2021 is, thus, disposed of.
