Let a copy of this report be served to learned Advocate for the petitioner. It appears from said report that a land dispute pending between parties. Owing to the said dispute a Title Suit being No. 151 of 2023 is still pending before the Ld. Civil Judge (Junior Division), Siliguri. All disputes are civil in nature.
Basing on the said findings the Investigating Officer filed Final Form Vide No.
06 of 2025 on 5th January, 2025 to the Court of Ld. Additional Chief Judicial Magistrate, Siliguri.
He prayed for a direction to respondent police authority for quick filing of chargesheet after proper investigation. As such the instant writ application is disposed of.
As a result, the instant writ application become infructuous as the grievance of the petitioner has resolved by filing of the chargesheet. Accordingly, the instant WPA/1469/2023 stands dismissed as infructuous.
There is no order as to the cost.
Interim order/orders, if any, stands vacated.
