Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction C.R.M. (A) 487 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bhaktinagar Police Station Case No. 1063 of 2023 dated 03.12.2023 under Sections 306 of IPC.

Heard learned counsels for the parties.

The petitioners seek parity with the co accused who have been granted bail/anticipatory bail earlier. Learned counsel for the State opposes the prayer. The principal accused as well as other co accused are on bail/anticipatory bail. The petitioners being similarly circumstanced deserve the same benefit.

Accordingly in the event of arrest, the petitioners Sunil Das & Sujit Kumar Ghosh @ Sujit Ghosh @ Kala be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer

and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is thus disposed of.
