1. The application for anticipatory bail is pressed on the ground that the co-accused brothers have been granted anticipatory bail by a Co-ordinate Bench of this Court.
2. The allegation of the de facto complainant is that the husband went to visit his brothers and thereafter committed suicide at another place. The de facto complainant could not have personal knowledge of the intimidation or abetment by the brothers of the suicide.
3. In the above circumstances, having regard to the observations of the Co-ordinate Bench of this Court dated 10th July, 2024 passed in C.R.M.(A) No. 471 of 2024, the petitioner shall be entitled to anticipatory bail.
4. It is directed that in the event of arrest, the petitioner shall be released on bail to the satisfaction of the
arresting officer upon furnishing a Bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local subject to the conditions that the petitioner shall appear before the Investigating Officer of the case once in a fortnight till the conclusion of the investigation and on further condition that the petitioner shall appear on every date of hearing before the jurisdictional Court until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. In default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.
5. This order is subject to the conditions laid down in sub-section (2) of Section 438 of the Code of Criminal Procedure corresponding to Section 482(2) of the BNSS, 2023.
6. The Case Diary be returned.
7. C.R.M. (A) No. 579 of 2024 is, thus, disposed of.
