...for the petitioners This is an application wherein the petitioners seek expeditious hearing of a pending application under Order VII Rule 11 of the Code of Civil Procedure, 1908.

It is contended on behalf of the petitioners that despite the application being filed as far back as on 25.03.2025, the Trial Court is repeatedly adjourning the application and there is no chance of early hearing of the same. In this connection, the petitioner relies on the orders dated 25.03.2025, 02.05.2025 and 26.06.2025 all of which have been mechanically passed adjourning the application and the application has been fixed for hearing on 29th July, 2025. It is evident that the application is being routinely adjourned without any justifiable cause. In view of the prayer made on behalf of the application and considering the facts and circumstances of the case, CO/131/2025 is

disposed of by directing the Learned Civil Judge (Junior Division) at Jalpaiguri to hear and dispose of the pending application under Order VII Rule 11 of the Code of Civil Procedure, 1908 filed in the above suit within a period of four weeks from the next date of hearing i.e. 29th July, 2025.

The petitioner is also directed to communicate this order forthwith to the respondent as well as their Advocates appearing before the Trial Court.
