This is an application under Article 227 of the Constitution of India.

From the endorsement of the Registry it appeared that no caveat was lodged.

The petitioner being the wife of the opposite party no.1, initiated a proceeding for annulment of marriage being Matrimonial Suit No.455 of 2021 under Section 27 of the Special Marriage Act, 1954. The plaintiff/petitioner had also filed an application under Section 36 of the Special Marriage Act, 1954. From the order sheet annexed to this revisional application it appeared that, time and again from time to time the proceeding was adjourned on one ground or the other.

Considering the materials on record and considering the submission made by Ms. Rikta Sarkar, learned advocate appearing for the petitioner, this civil revision petition stands allowed with a request to the jurisdictional Civil Court to expedite and conclude the

hearing of Section 36 application, in accordance with law, pending before it within two months from the date of communication of this order.

Learned jurisdictional civil Court is further requested to conclude the hearing of the Matrimonial Suit No.455 of 2021 as expeditiously as possible, preferably within a period of one year from the date of communication of this order.

No unnecessary adjournment shall be granted.

With the above observations, the revisional application, C.O. 97 of 2022 stands allowed without any order as to costs.
