The opposite party is not represented despite service.

The petitioner seeks transfer of Miscellaneous Case No. 85 of 2021 pending before the learned Additional Chief Judicial Magistrate, Tufanganj to any competent Court in the district of Alipurduar on the ground that the petitioner is a resident of Alipurduar and the Matrimonial suit filed by the opposite party against the petitioner is pending at Alipurduar. Though the suit has been dismissed for default, an application has been filed for restoration of the same.

In view of the fact that the petitioner is a resident of Alipurduar and the other suit between the parties is likely to be in Alipurduar Court, Miscellaneous Case No. 85 of 2021 be transferred from the Court of the learned Additional Chief Judicial Magistrate, Tufanganj to the Court of the learned Chief Judicial Magistrate, Alipurduar. The learned Chief Judicial Magistrate, Alipurduar shall either take up the matter for consideration himself or transfer the same to any other Judicial Magistrate within his jurisdiction for disposal.

The learned Additional Chief Judicial Magistrate, Tufanganj is directed to transmit the record of Miscellaneous Case No. 85 of 2021 alongwith all relevant documents thereto to the Court of the learned Chief Judicial Magistrate, Alipurduar within 10 days from the receipt of this order.

CRR 347 of 2025 is accordingly allowed.
