Heard learned counsels for the parties.
The victim expired due to consumption of poison when she was in her family way.
The petitioners are the brother in law and sister in law of the victim. Charge sheet has been submitted. The co accused are on bail. No specific overt act has been attributed to the petitioners in the alleged incident. No external or internal injury has been detected in the person of the victim.
Learned counsel for the State opposes the prayer. Considering the material on record as well as extent of complicity of the petitioner in the alleged offence, this
Court is inclined to hold that the petitioners be granted anticipatory bail.
Accordingly in the event of arrest, the petitioners Rajesh Kabir @ Firoj & Farhin Islam be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date. The petitioner shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The application for anticipatory bail is thus disposed of.
