(A) 500 of 2025 In Re : An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Siliguri Police Station Case No. 172 of 2025 dated 16.03.2025 under Sections 126(2)/109/324(4)/351(3)/61(2) of BNS.

And In Re : Nehal Singh @ Nehal Kherwar ...petitioner.

Mr. Mayank Bhandari ... for the Petitioner.

Mr. Saikat Chatterjee Mr. Chattu Roy ... for the State.

Heard learned counsels for the parties.

The petitioner seeks parity with the co accused who have been granted anticipatory bail earlier.

Learned counsel for the petitioner submits that the petitioner is a HIV positive patient and is undergoing treatment.

Learned counsel for the State does not oppose the said fact.

In view of the fact that the petitioner is similarly circumstanced with the co accused who have been granted anticipatory bail, he deserves the same benefit. Accordingly, in the event of arrest, the petitioner Nehal Singh @ Nehal Kherwar released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand),

with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

Considering the medical condition of the petitioner, this Court directs the petitioner to appear before the investigating officer of the case as and when called for by the investigating officer.

The application for anticipatory bail is thus disposed of.
