The petitioner's husband was abducted and severely assaulted by the accused. He suffered severe injuries. There was an alleged attempt to murder him. In spite of this, the police have been lax in investigating the case. It appears that the local police officers have close connection with some of the accused. The accused are roaming freely and have not been arrested yet.

Learned counsel appearing on behalf of the respondent accused denies the allegations and submits that a hype has been created over the issue because the defacto-complainant is an influential advocate. An application for anticipatory bail of some the accused is pending consideration before the learned Session Judge.

Learned counsel appearing on behalf of the State denies the allegations of police inaction and submits as follows. Necessary documents have been seized and statements of witnesses recorded in this case. In fact, the statements of the victim and an eyewitness were recorded before the learned Magistrate. A CDR analysis is being done of relevant mobile phone numbers.

Heard the learned counsels for the parties and perused the case diary.

Serious allegations have been leveled in the FIR.

The police have also taken some steps in investigating the offence like recording statements of witnesses including the victim before the learned Magistrate and collecting medical reports.

However, it is quite surprising that the police have not been able to apprehend the prime accused. It is also contended on behalf of the respondent accused that an application for

anticipatory bail of some the accused is pending before the learned Session Judge.

In view of the above, let the Investigating Agency conclude the investigation expeditiously and take all possible steps which are necessary in taking the matter to its logical conclusion in accordance with law and at the earliest. They shall, however, conduct such investigation under the direct supervision of the Commissioner of the Siliguri Police Commissionerate.

The learned Court, while deciding the application for anticipatory bail of the accused, shall not be swayed by any observation made herein. With these observations, the writ petition is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
