m This is an appeal directed against an order dated 15 March, 2024 dismissing an application for temporary injunction.

On behalf of the appellant, an adjournment is sought for to place the matter before the next available Circuit Bench.

The matter has been heard on repeated occasions i.e. 30 June, 2025 and 9 July, 2025. The Report of the Stamp reporter indicates that the appeal is beyond the period of limitation and despite the direction of an earlier Coordinate Bench dated 2 September, 2024, no application for condonation of delay has been filed till date.

In view of the above, it is obvious that the appellant is only interested in procrastinating this proceeding and is not serious and diligent in proceeding with this appeal. Such delay is deliberate, intentional and calculated.

In view of the above, FMAT/12/2024 stands dismissed.

The Trial Court is requested to act expeditiously in accordance with law and conclude the hearing of the suit.
