IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction WPA No. 1495 of 2023 Bulti Barman Vs.

The State of W.B. & Ors.

Mr. Kamalesh Bhattacharya Mr. Surajit Basu Mr. R. C. Roy ...for the petitioner.

Mr. Bikramaditya Ghosh Mr. Pretom Das ...for the State.

Affidavit of service filed by the petitioner is taken on record.

It is contended on behalf of the petitioner that pursuant to an advertisement floated by the 3rd respondent on 19th May, 2022 inviting applications under the West Bengal Public Distribution System (Maintenance & Control) Order, for appointment against a vacancy in a fair price shop at Dinhata-II in district Coochbehar, the petitioner being eligible for the appointment, applied before the authority along with requisite fees and relevant documents on 12th July, 2022.

Learned counsel for the petitioner submits that despite sufficient time having lapsed the respondents have not made any communication to

the petitioner as to acceptance of the tender submitted by her. The petitioner seeks a direction upon the authority to publish the result of the tender at the earliest.

Learned counsel for the respondents, in his usual fairness, submits that the respondents be given three weeks time to publish the result of the tender, as prayed for by the petitioner.

In view of the above, the writ petition is disposed of directing the 4th respondent to publish the result of the tender in question within three weeks from the date of communication of this order, in accordance with law.

With the above observations and directions the writ petition is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
