The petitioner is a contractor in respect of a tender that was floated by the Government. A work order dated 04.12.2017 was issued. The petitioner completed the work. In fact, Out of a total bill raised by the petitioner for a sum of Rs. 16 lakhs and odd, Rs. 13 lakhs and odd has already been paid. However, The rest amount was not paid. No reason was cited for the same. The petitioner made several representations in this regard to the concerned respondent authorities, but no response came.

Learned counsel appearing on behalf of the State submits that if representations had been made to the concerned authorities, the same would be considered in accordance with law.

It appears that the petitioner had made several representations before the Block Development Officer, Cooch Behar-I, Dev Block in respect of eTender ID: 2017_DMCB_126250_1. But, the same were not responded to.

In view of the above, let the respondent authorities particularly the respondent no.6 consider the representations made by the petitioner in this regard in accordance with law and as expeditiously as possible, preferably within a period of four weeks from the date of communication of this order. Within a week thereafter, the concerned respondent shall intimate the petitioner about the outcome of such consideration.

With these observations, the writ petition is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
