It is contended on behalf of the petitioner that a criminal case was registered before the Kotwali police station on the basis of a written complaint lodged by the petitioner under Sections 406/468/471/506//34 of the Indian Penal Code. Charge sheet was submitted in the said case without the experts report with a prayer for liberty to submit supplementary charge sheet.
Learned counsel for the petitioner submits that though the matter is ready for evidence, supplementary charge sheet annexing the experts report has not been filed as yet.
Placing reliance upon the report submitted by the Inspector-In-Charge, Kotwali police station, Jalpaiguri, learned counsel for the respondents submits that supplementary charge sheet annexing the report of the examiner of questioned documents, QDEB, C.I.D. West Bengal has been submitted before the Court on 22nd July, 2023.
In view of the above, nothing further remains to be adjudicated in the writ petition and as such, the same is disposed of.
There shall however be no order as to costs.
Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
