Heard learned counsels for the parties.
Learned counsel for the petitioner submits that the petitioner is a partner of the partnership business and is the owner of the entire property in dispute. Electricity connection taken by the company has been utilized for the various shops in the premises owned by the partnership firm. The petitioner complained before the authority of unauthorized supply of electricity being taken by the tenants of his premises without his consent. As a retaliation, the present complaint has been filed. Learned counsel for the State opposes the prayer.
I have considered the material on record. The petitioner has produced relevant title deed and partnership deed in support of his contention. He has responded to the notice issued upon him under Section 35(3) of the BNSS. Therefore it can be inferred that the petitioner has co operated in investigation and his custodial interrogation is not required.
In view of the above, this Court is inclined to grant anticipatory bail to the petitioner.
Accordingly in the event of arrest, the petitioner Ananda Saha be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand), with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.
The application for anticipatory bail is thus disposed of.
