Petitioner has prayed for quashing of the proceedings arising out of Kotwali Police Station Case No.845 of 2022 dated 10.12.2022 corresponding to G.R. Case No. 6842 of 2022. In the said case, police authorities submitted chargesheet under Sections 305/34 of the Indian Penal Code. The present petitioner is a teacher who has been implicated in connection with the instant case. In view of the observations made and the findings arrived at by this Court in CRR 254 of 2024 relying upon the judgement of Mrs. D.A. Macgillivary Vs. State reported in 1986 C Cr LR (Cal) 233 along with the referred judgements of Netai Dutta Vs. State (2005) 2 SCC 659 and GEO Varghese Vs. State of Rajasthan & Anr. (2021) 19 SCC 144, I am of the view that further continuance of the proceedings, so far as the present petitioner is concerned, would be an abuse of the process of law as the charges, under Section 305 of the Indian Penal Code, are not made out so far as the present petitioner is concerned who is a teacher of Suniti Bala Sadar Girls' School.
Accordingly, all further proceedings relating to Kotwali Police Station Case No.845 of 2022 dated 10.12.2022 corresponding to G.R. Case No. 6842 of 2022 are hereby quashed.
Consequently, the revisional application being CRR 361 of 2025 is allowed.
Pending application, if any, is disposed of.
