It is submitted on behalf of the respondents that pursuant to the representation submitted by the petitioner on 19th June, 2023, the present Investigating Officer has resumed investigation. The Superintendent of Police, Jalpaiguri has directed initiation of departmental proceedings against all the previous Investigating Officers for their lapse in investigating the case. The present Investigating Officer has, in course of investigation, examined several witnesses including the suspects named by the petitioner. The report demonstrates that investigation of the case is in progress.

In view of the above, nothing further remains to be adjudicated in the writ petition and the same is accordingly disposed of.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
