The petitioner is aggrieved by the nature of the progress of the investigation.

Learned advocate appearing for the State submits that the police authorities have exercised their due diligence and in spite of that failed to bring principal offenders. Steps are being taken by the Investigating Agency. The petitioner is definitely anxious regarding the outcome of the investigation. There are certain compulsions of the court for interference in course of investigation.

The petitioner is granted liberty to pray for an application before the learned special court being the original court wherein the learned court would consider the circumstances and take a decision as to whether there is any reluctance on the part of the Investigating Agency. In case learned special court

finds any reluctance, learned special court would direct the Investigating Agency or its superior for answering the said deficiency.

Report submitted by the learned advocate for the State be kept with the record.

With the aforesaid observations, WPA No.2128 of 2022 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if sapplied for, be given to the parties upon compliance of all requisite formalities.
