Abhishek Sarkar, learned advocate appearing for the petitioner, on instruction submitted that, there is some technical defect in the prayer portion of the writ petition. As such, the writ petitioner seeks to withdraw the said writ petition and is praying for leave to file afresh on the selfsame cause of action.

Mr. Bikramadity Ghosh, learned counsel appearing for the School Service Commission, pursuant to the direction made earlier, has filed the affidavit-in-opposition, the same is taken on record. Ms. Bedashruti Bose, learned State counsel appeared in the matter.

In view of the prayer made by the writ petitioner, this writ petition, WPA 2133 of 2022 stands dismissed as withdrawn with liberty to file

afresh on the selfsame cause of action subject to payment of cost of Rs.500/- (Rupees five hundred only) to be paid to the Legal Services Authority, Circuit Bench at Jalpaiguri.

This cost is imposed because a direction was made for filing affidavit in the writ petition and pursuant to that direction, affidavit-in-opposition has already been filed.
