Apprehending arrest in connection with Rajganj Police Station Case No. 367 of 2019 dated 08.11.2019 under Sections 143/341/186/332/333/353/307 of the Indian Penal Code read with Section 3 of the PDPP Act, the present application has been filed.

The petitioner is represented. The State is also represented.

The attention of this Court is drawn to an order dated 22nd September, 2021 of the concurrent Hon'ble Division Bench. By the said order, the Hon'ble Bench was pleased to grant pre-arrest bail to the co-accused connected to the same police station case namely, Rajganj Police Station Case No. 367 of 2019 dated 08.11.2019. The petitioner claims to be on the same footing as the co-accused granted pre-arrest bail.

Upon examination of the materials placed, this Court is persuaded to treat the petitioner on a parity of reliefs as granted to the other co-accused by the order 22nd September, 2021.

Accordingly, the petitioner namely, Julfikar Ali @ Julfigar @ Julficar shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. The petitioner is put on the other conditions that he shall not enter the jurisdiction of Rajganj Police Station, save and except for meeting with the Inspector-in-Charge, Rajganj Police Station, once in a week on and from 1st December, 2021 until further orders.

The petitioner shall also intimate his residential address to the said Inspector-in-Charge, Rajganj Police Station and attend the Court on all dates of trial. With the aforesaid directions, the application for anticipatory bail, being CRM 1064 of 2021 stands disposed of.
