Appellate Side Suman Ct. 01 Allowed CRM (A) 534 of 2025 In re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Dinhata Police Station Case No.625 of 2024 dated 09.12.2024 under Sections 126(2)/115(2)/118(2)/109(1)/74/351(2)/3(5) of the Bharatiya Nyaya Sanhita and corresponding to G.R. Case No.670 of 2024 pending before the learned Additional Chief Judicial Magistrate, Dinhata.

... petitioners Mr. Anand Paul ..for the petitioners Mr. Kallol Acharjee Mr. Tapan Bhattacharjee ..for the State The prayer for anticipatory bail in respect of petitioner no. 1 is not pressed.

State appears to oppose the prayer of petitioner no. 2, citing the statement of the victim recorded under Section 161 of the Code of Criminal Procedure, 1973.

Having regard to the nature of the injury sustained by the victim, and considering the fact that petitioner no. 2 is a lady aged about 45 years and that the charge sheet has already been filed in this case, I am of the view that custodial interrogation of petitioner no. 2 at this stage is not necessary.

Accordingly, the prayer for anticipatory bail is allowed. Petitioner no. 2, namely Lakshmi Roy, in the event of arrest, shall be released on bail upon furnishing a bond of Rs. 5,000/- (Rupees Five Thousand only), with two sureties of like amount, to the satisfaction of the learned Additional Chief Judicial Magistrate, Dinhata, and subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), and on the further condition that the petitioner shall appear before the jurisdictional court on every date fixed for appearance of the accused.

In default of appearance, the jurisdictional court shall be at liberty to pass appropriate orders to secure the presence of the petitioner, including cancellation of the anticipatory bail granted herein, without further reference to this Court.

Accordingly, CRM (A) 534 of 2025 is allowed in respect of petitioner no. 2, namely Lakshmi Roy.

Let an urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on the usual undertakings.
