The petitioner was appointed by the Secretary of Dumniguri Amina Bibi Senior Madrasah, District-Cooch Behar. This was a decision of the managing committee. The petitioner was promised to be paid a monthly honorarium. The petitioner alleges that the authorities of the madrasah changed the staff pattern by deleting the name of the petitioner. Petitioner apprehends that such staff pattern had been forwarded to the Director of Madrasah Education. The petitioner contends that the authority of the madrasah had intentionally deleted the name of the petitioner from the staff pattern, although the petitioner continues to serve.

Reliance has been placed on a letter issued by the Secretary of the said institution dated July 24, 2021. It appears that the petitioner along with some others were assured that their services would be retained in the madrasah.

Such staff pattern was allegedly prepared as the Assistant Inspector of Schools (Secondary Education) and Madrasah-in-Charge, Cooch Behar, by a letter dated March 23, 2021, had asked the Secretary of the madrasah to furnish certain documents on the basis of the complaint filed by one Rampada Biswas and five others.

It appears that the District Officer of Minority Affairs, Cooch Behar had instructed the Assistant Inspector of Schools (Secondary Education) and Madrasah-in-Charge, Cooch Behar to make an enquiry. Pursuant to such direction, the Assistant Inspector of Schools (Secondary Education) and Madrasah-in-Charge had directed the Secretary of Dumniguri Amina Bibi Senior Madrasah to produce the relevant documents and the staff pattern.

The writ petition is disposed of grating liberty to the petitioner to file a comprehensive representation before the District Officer of Minority Affairs, Cooch Behar. The said authority shall consider the grievance of the petitioner and

pass a reasoned order within a period of eight weeks from the date of receipt of the representation.

This Court has not gone into the merits of the allegation of the petitioner.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
