The petitioner has prayed for quashing of the proceedings relating to Pradhan Nagar Police Station Case No. 636 of 2020 dated 23.09.2020.

Learned advocate appearing for the petitioner submits that there was a relationship between the alleged victim and the present petitioner and as an outcome of the same, the present case was registered on the complaint of the mother of the lady.

The offences complained of are under Sections 363/365 of the Indian Penal Code. The records of this revisional application reflect that at the relevant point of time, the victim was 17 years old. Having regard to the age of the victim, the materials collected by the investigating agency and the fact that charge-sheet has already been submitted, I am of the opinion that there is no scope for interference regarding the continuance of the proceedings.

However, the petitioner would be at liberty to agitate the points canvassed in this revisional application at the appropriate stage before the learned trial court after obtaining the documents under Section 207 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 185 of 2022 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
