Criminal Appellate Jurisdiction C.R.M. 1067 of 2021 (Via Video Conference) In Re : An Application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed in connection with Pulbazar P.S. Case No. 18 of 2021 dated 28.07.2021 under Section 354C of the Indian Penal Code read with Sections 66E/67/67A of Information and Technology Act, 2000.

Md. M. Nazar Chowdhury Ms. Priyanka Saha ... for the petitioner Mr. Kallo Acharjee Mr. Biswarup Roy ... for the State. Learned advocate for the petitioner submits that the petitioner is a labour and he has been falsely implicated by the de facto complainant.

Learned advocate for the State submits that incriminating materials have been collected which corroborates the First Information Report and the investigation of the case is in progress.

Having regard to the fact that investigation of the case is still in progress, we are of the view that this is not a fit case for extending the privilege of the anticipatory bail to the petitioner. Accordingly, CRM 1067 of 2021 is dismissed.

All parties shall act on the server copy of this order, duly obtained from the official website of the Hon'ble High Court Calcutta.

Urgent Xerox certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
