30.07.2024 Ct. No.02 NB HIGH COURT AT CALCUTTA In The Circuit Bench At Jalpaiguri Appellate Jurisdiction WPA 1472 of 2024 Smriti Rai Khaling Vs.

The State of West Bengal & Ors.

Mr. Shanta Sarkar.

...for the petitioner.

Mr. Sumit Kumar, Mr. Kumar Shantanu.

...for the State.

Affidavit of service filed on behalf of the petitioner is taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's father was a lecturer in a college. After he retired, a PPO was issued and pension was started. He breathed his last on 29.06.2010. Family pension was started in favour of the widow/mother of the petitioner. She died on 20.05.2018. In the meantime, a Government Order was issued dated 04.02.2011 granting Arrear, LTA Pension in favour of the petitioner's father for a period between 2006 and 2010. However, this sum has not been disbursed in favour of the petitioner as yet. Several representations were made in this regard to the concerned respondent authorities, especially the last one on 29.09.2023.

Learned counsel appearing on behalf of the State submits that although there is a delay in preferring a representation in this regard, since a Government Order had already been passed sanctioning arrear, LTA Pension in favour of the petitioner's father, the amount would be disbursed in due course.

It appears that there was a Government Order issued quite some time ago sanctioning payment of Arrear, LTA Pension in favour of the petitioner's father. Since the same has not been disbursed yet, let the respondent no.3 take appropriate measures to have the same disbursed in favour of the heir of the deceased employee after verifying relevant documents in this regard in accordance with law and as expeditiously as possible, preferably within a period of eight weeks from the date of communication of this order.

With these observations, the writ petition is disposed of.

Urgent Photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. .
