The petitioner claims to have been engaged as Gram Panchayat Karmee against a vacant sanctioned post in the office of the Haribhanga Gram Panchayat under Coochbehar-1 with effect from 9th September, 2014. He claims that he is in service from 2013 till date.

The prayer of the petitioner for regularization was forwarded by the Block Development Officer, Coochbehar-1 Development Block to the District Panchayat and Rural Development Officer, Coochbehar in the year 2020 but thereafter, no steps were taken for regularizing his service.

The petitioner claims benefit in terms of the memoranda issued by the Finance Department (Audit Branch) from time to time.

A representation was filed on behalf of the petitioner in February 2022 before the District Panchayat and Rural Development Officer, Coochbehar but the same is yet to be considered.

As it appears that the prayer of the petitioner forwarded by the learned advocate is pending consideration at the end of the respondent authorities, accordingly, the present writ petition is disposed of by directing the respondent no.4 being the District Panchayat and Rural Development Officer, Coochbehar to consider and dispose of the representation made by the petitioner strictly in accordance with the relevant guidelines/memoranda/rules applicable in the field and pass a reasoned order at the earliest but positively within a period of eight weeks from the date of communication of a copy of this order and communicate the same to the petitioner immediately thereafter.

It is made clear that this Court has not entered into the merits of the claim made by the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioner.

The petitioner is directed to forward a copy of the representation dated 14th February, 2022 along with all other supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
