The application for anticipatory bail is made on the ground that before the incident the petitioner, who was tea stall owner, had hot altercation with the policemen. The present FIR is stated to be a result of revenge by the police.

This Court notes that 60 bottles country liquor and two bottles of IMFL have been recovered from the petitioner's residence. The date of seizure was immediately preceding the Holi festival.

This Court prima facie satisfied that the petitioner violated the provisions of the Bengal Excise Act, 1909. 4.

Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

The petitioner may comply with the statement under section 161 of the CrPC.
