1. Being aggrieved by and dissatisfied with the order dated 12.11.2024 passed by the Learned Chief Judicial Magistrate, Jalpaiguri issuing warrant of arrest, the instant revisional application has been preferred.

2. Learned counsel appearing on behalf of the petitioner has submitted that on five consecutive dates petitioner could not appear before the court due to serious illness.

3. Learned counsel appearing on behalf of the petitioner sought for liberty to surrender before the Trial Court.

4. Learned counsel appearing on behalf of the State also submitted that necessary liberty may be given to the petitioner to appear before the learned Trial Court.

5. From the order impugned in this revisional application, I do not find any infirmity or illegality to exercise the power under Section 528 of the BNSS.

6. Accordingly, the revisional application stands dismissed with liberty to the petitioner to surrender before the Trial Court within seven days from the date and to file appropriate application.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

8. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

9. Parties are at liberty to communicate this order to the learned Trial Court for information.
